100630 Park Chan Jong “It Is Essential That SM Concedes To Settle The Case”

With three members of TVXQ, YoungWoong Jaejoong, Xiah Junsu and Micky Yoochun filing an exclusive contract invalidity confirmation and unjust enrichment restitution lawsuit that demands a three billion Won compensation, and SM Entertainment stating that they will strongly take action against this, it seems that this case seems to be growing rapidly instead of being solved.

And amidst the fearful voices being raised that this case could negatively affect the Hallyu Boom, Lawyer Park Chan Jong lamented about the unfortunate nature of this situation and stated, “‘TVXQ’, who is known so well overseas, is an important cultural asset that our nation must protect and nurture. It is a tremendous national loss that ‘TVXQ’ has been unable to perform in an amicable environment since the group’s dispute with their agency SM began in July, 2009.”

And regarding the root cause, Park Chan Jong diagnosed that, “The case started because of the ‘slave contract’ signed between ‘TVXQ’ and ‘SM’ that is made of extremely unequal clauses such as one that makes it basically impossible for ‘TVXQ’ to cancel the contract.” He also revealed that, “Because this contract was signed when ‘TVXQ’ were minors under the age of 19, ‘SM’ could be legally held responsible for ‘Crime of Unjust Enrichment (Clause 349)’ and ‘Crime of Fraud (Clause 348)’ against minors.”

On the other hand, TVXQ filed for an exclusive contract validity suspension injunction last July, 2009 against SM, and following this, SM filed a 2.2 billion Won compensation lawsuit against the trio as well as an objection to the verdict made regarding the injunction. Afterwards, the TVXQ trio filed a lawsuit against SM on June 28, 2010 demanding that the agency pay each member one billion Won for a total of three billion won.

Lawyer Park proposed three alternatives for an amicable solution to this case.

First, the individual activities carried out separately as three members and two members due to the lawsuit must stop, and TVXQ must return to its original five-member status.

Second, SM essentially is responsible for and is the root cause of this case. Therefore, SM must become the forerunner in finding a solution to this case.

Third, haven’t the Courts recognized that the exclusive contract of ‘TVXQ’ is an unequal one? Therefore, ‘SM’ must not be taking action with a lawsuit of their own, but should instead be conceding and showing the initiative that they want to settle the issue.

Following this, he said, “The many domestic and overseas supporters who love and care for ‘TVXQ’ truly wish to see the members performing together as five again as soon as possible,” and “I hope that ‘SM’ does not disappoint the hopes and dreams of these people.”

SM TOWN 2010 LA-Shanghai-Tokyo World Tour

SM TOWN Live 2010 will be held in different parts of Asia and in LA. For those who wants to see Yunho and Changmin or the other SM artists, just read the info below.

100701 SM TOWN 2010 LA-Shanghai-Tokyo World Tour Starts

SM Entertainment will commence with the large-scaled SM TOWN LIVE ’10 WORLD TOUR performances starting next month on the 21st in LA , Shanghai, Tokyo, and other major cities in Asia.

The opening stage in Seoul will be held at 5PM on August 21 at the Olympic Stadium. Following that is September 4 at the LA Staples Center in the United States and September 11 at the Shanghai Hongkou Football Stadium. The specific details regarding Tokyo, Japan are still in the midst of negotiations.

This isn’t the first time that SM Entertainment has held SM TOWN outside of Korea. Early in 2008, the stages in Bangkok, Thailand and Shanghai, China were already successful experiences. But this is the first time it has stepped out of Asia, despite LA being the only place.

The list of artists include KANGTA, BoA, U-Know, MAX, Super Junior, Girls’ Generation, SHINee, f(x), Trax, and all the other SM artists. The audience will get to enjoy a full 5 hours of the magnificent stage.

The tickets for the Seoul stage will start selling on July 15 at 8PM through the internet at G Market Korea (http://ticket.gmarket.co.kr). On July 13, the tickets will also be sold through Fan Clubs.

The SM TOWN LIVE Concerts aren’t only for friends or lovers, but also a good summer music festival for the whole family to go to. Happy family seats will also be available to purchase in advance from the 15th onwards at (02-323-8500).

I still hate SM Entertainment but I did promise that I will support Yunho and Changmin so I’m only excited for their song and not the whole album. I wonder if it will be a ballad? The title sounds like a ballad and I will be happy if it’s a self-composed song. I may be over-fantasizing but I am hoping it’s a reply to JaeJoong, Yoochun and Junsu’s “W”. =)

Conflict between TVXQ fans & Max Matsuura on Twitter

I haven’t been on twitter the past days that’s why I didn’t know about this incident.

“Ayumi Hamasaki intercedes conflict between Tohoshinki fans and Avex president”

There was a little conflict recently between Tohoshinki fans and Matsuura Masato the president of Avex, on twitter.

The conflict started when fans asked him about Tohoshinki. Matsuura tweeted, Wanting them to get back together is my wish, but not getting back together is their decision.

Fans were upset by his tweet and said to him, Dont you know how many fans would get hurt by words like this?, Why dont you stop tweeting?, Stop saying stuff as if you know everything.

Matsuura tweeted back to the fans again, Then dont ask me anything, and dont believe my words, You want me to lie about that?

Then people who are not Tohoshinki fans tweeted to him, You are being too immature, You should know how effective your words are to fans.

The twitter exchange became over heated, and Ayumi Hamasaki tweeted on behalf of Matsuura to the Tohoshinki fans.

Please stop pushing all your anger and sadness only on Masa(Matsuura). Because of his position, he had to know something he didnt even want to know. Isnt Masa the same as you (fans)? Who didnt give up, even after going through all that pain?.

I don’t really know what happened but based on the article above, I think both parties – Max Matsuura and the fans – are at fault here. I won’t be hating Avex like the way I hate SM Entertainment (I guess, my hatred for SME is incomparable) for saying sensitive matters like this but I do think that what Max Matsuura did was, in a way, improper. Definitely, a lot of fans were hurt and got worried by what he said. The fans’ hearts are in a very sensitive state right now and saying those kinds of things would surely affect us.

But I think the fans are also at fault. They shouldn’t ask Max Matsuura such questions related to TVXQ at the moment especially those pertaining to their relationship and plans as a group in the future. We all know that Max Matsuura is quite a frank guy and he sometimes says things that shouldn’t be said publicly. If the fans are not ready to accept the answers that come from him, whether positive or negative, then we shouldn’t ask any questions in the first place.

My point is that what Max Matsuura said is indeed sensitive and most of the time he’s being a bit too tactless but we can’t fully blame him because he’s only answering the questions of the fans based on his own opinions or what he knows. If we, the fans, are not ready to hear anything negative, then let’s just stop asking him questions about the boys. We also have to understand that he can’t always give us positive answers and hopeful comments if we expect him to answer our questions honestly.

Being open-minded is the key in the situation we are in right now because if we’re not going to open our minds to everything and be understanding, then we’ll just get hurt over and over again.
