It’s been a very long time since I last posted a blog entry that solely contains what I feel and what’s been running on my mind. After the whole issue about DBSK splitting to JYJ and the new DBSK composed of HoMin, I haven’t written a lot of opinionated posts anymore. I actually missed writing such posts and I have attempted a lot of times to try and write one again but I just don’t seem to have the motivation to write anything anymore. Maybe it’s because most of the time, voicing out what I feel and what I think of the situation hurts so much. I just stopped writing because I wanted to avoid the pain.

But tonight, I just can’t help but express what I feel by writing an op-ed. I’ve been holding back for so long that I think it doesn’t matter anymore if I’m being re-acquainted with the pain I felt because of DBSK.

For the past few days, I’ve been checking out information about SM Entertainment’s new group EXO. I was curious because a lot of the people I know who likes to listen to K-pop has been talking about this rookie group. True enough, they are indeed an interesting bunch of guys. I think their songs are good, they have powerful dance choreography and the members Luhan, Kris, Sehun and Suho really caught my attention. I was ALMOST ready to join in the EXO bandwagon and start fangirling over them.

But then everything changed when I saw a video yesterday while looking  up for some videos of EXO. It was a video of DBSK’s performance of Bolero during their 4th Live Tour in Tokyo Dome. I clicked it and watched the video and suddenly, I found myself mesmerized by DBSK all over again. I suddenly found myself crying while watching my precious boys singing and I ended up watching a lot of their old videos and cuts from their concert tours.

Watching their videos made me realize so many things that I think I have tried to neglect and forget ever since they split into two groups.

I realized that because I was trying to avoid the pain of seeing them separated, I slowly and unconsciously drifted away from DBSK. I busied myself with work and attempted to try to look for another K-pop group to like and support. But even though I’ve been trying to ‘discover’ other groups for months now, I still can’t find a ‘suitable’ one to replace DBSK. I don’t see myself following their careers and sharing their happiness and pain like I did with DBSK. At first I thought I might really be losing my interest in K-pop, that maybe I’m getting tired of it. But now I know why I can’t seem to love any other K-pop group. It’s because DBSK is really irreplaceable. What other Cassies say is true, once you’re into DBSK, there is no turning back. I think if you’re a hardcore DBSK fan, a Cassiopeia, it’s really hard to like other groups because DBSK is just so great that it would be hard to look for a group who could match their greatness. What they have and what they can do is beyond anyone’s imagination. I have not seen any other group that can produce a beautiful harmony as DBSK. DBSK is the most precious miracle that happened in Asian pop.

I also realized that no matter how much I’m hurting over the fact that Yunho and Changmin still uses DBSK as their name and no matter how much I try to ignore them in hopes of reducing the pain and disappointment I’m feeling, I still care for these two guys so much. I may be more vocal of my support to JaeJoong, Junsu and Yoochun and I may be indifferent towards Yunho and Changmin but that doesn’t mean I don’t love them anymore. Yes, it still disappoints me whenever I hear them use the name DBSK to refer to their two-member group, it still hurts whenever I look back at the interviews where they said a few statements that could have hurt their brothers but then I realized it’s impossible for me to hate any of the five members because they are still, and always will  be my most treasured boys who hold a very special place in my heart.

And lastly, I realized how much I miss Cassiopeia. I miss the Red Ocean, that awesome fandom who is willing to do anything for our five stars. Part of the reason why the separation of DBSK is such a hard thing for me to bear is because along with the group’s split also came the division of Cassiopeia. For someone like me who draws strength from the knowledge that Cassiopeia is still one and united, the division of the fandom was something that really broke my heart. During the early period of the split, I had managed to keep my hope and faith intact but when I realized that Cassiopeia is slowly breaking into two just like DBSK, I lost hope and I myself began to take sides. But after looking back at Cassiopeia’s efforts for DBSK in the past, after looking at how beautiful a united Red Ocean looks like, I realized that I shouldn’t have given up and that I should never give up. Yes, it’s painful to know that K-pop’s most awesome fandom is in chaos right now but I believe that there are still those Cassies who still believe in the five members, those who are still keeping the faith. I also believe that those who have tried to run away and find comfort in another group/fandom will still come back to Cassiopeia and DBSK in the end, just like what happened to me. After all, once a Cassiopeia, always a Cassiopeia.

What DBSK and Cassiopeia has is a special bond like no other. We are at a point wherein our relationship is no longer that of an idol-fan. DBSK and Cassiopeia have become one in heart, mind and soul. We are no longer two separate beings who can easily turn away from each other. Through the years, we have shared each others’ happiness and pain and we’ve been through a lot of challenges together. This is another challenge that we have to face and we just have to stay strong for each other. One day, I believe that we can pass through this and all of this will be over. We just have to ALWAYS KEEP THE FAITH.

It feels great to be back home where I truly belong – to DBSK and Cassiopeia. :)

Next up, Junsu’s.

Awww… their Budokan Hall performance during their Five in the Black Tour must be really special to Junsu as much as their Tokyo Dome concert. I can still picture the how he cried together with Yoochun while singing “Proud”. That was a really touching moment that would probably be remembered by all DBSK fans. <3 I was laughing at his “weakness”. I remembered during their Family Outing guesting, he really had a weird way of sleeping and is a bit messy. Hahaha.

Junsu, the one in charge of comedy

He was so happy that he cried at Budokan Hall

Being in charge of comedy, he bring smiles by creating a warm atmosphere, Junsu “Actually I wanted to do this last year already, but because of saying cold gags in front of the members and on television programmes, I couldn’t take it back. (A/N: had to continue)

Behind that smile, he has shed a lot of tears.

“When we just came to Japan, it was very tiring to sing in Japanese because we were not used to it. We also needed translators when we were interviewed, so we were all very nervous.”

To improve their Japanese, and catch up with the pace of things, shorten the gap between the fans and them.

“My mind was focused on the Budokan Hall’s stage, for our fans love we worked hard, the feeling was good. The first time that I cried because of happiness in Japan was at the Budokan hall.”

Actually, coming to Japan was already hard from the beginning, but they were not afraid and practiced hard even before they debuted.

“My voice change took 3 years.”

I went to over 10 hospitals for check ups but they couldn’t find a reason to it. Our debut was canceled. It felt I had no chance to continue singing, I cried everyday…”

Dreams of performing on the stage were fulfilled when the news came of the formation of Dong Bang Shin Ki.

“Even though my throat wasn’t cured yet, if I didn’t grab this chance, my life would have come to a close (in singing)

I couldn’t let that happen! That provided me the strength and hope. From that time on, my voice slowly recovered. It’s incredible. It was like a miracle!”

Even though he faced a bitter past, he still carries a smile

Behind that smile is a strong will.

From 3 years ago, he has controlled himself from eating after six in the evening.
“This is so as to have a good body condition after waking up in the morning, it’s also good for the skin!”

This is a translation of the phone interview that IS Plus 일간스포츠 had with JaeChunSu’s lawyer just a few hours ago. I hope this clears some of the fans’ questions. There has been a lot of articles floating in the internet today and I honestly don’t know how to react. Some fans believe the articles while some are still in denial and are saying this is all a rumor. I also hope it is but reality is, it is a fact and we’ll have to accept that. All we need now is a clarification on certain matters because even though the news spreading now is true, the specific details to it are still making fans panic. We don’t actually know which of these details are facts and which ones are just embellishments by the media.  Of course, there’s no better way to calm us down than ‘to hear the side of the members. But it looks like we won’t hear from them anytime soon because as their lawyer had mentioned, they wish to keep quiet regarding the issue for now.

090801 Phone Interview with TVXQ’s Legal Representative

The following is phone interview with legal representation of the three members of TVXQ, Im Sang-hyuk from SEJONG law firm:

– What is the core of conflict?

“The irrational exclusive contract. If we review the contract standard from Fair Trade Comission (FTC), the longest duration of a contract is not to exceed 7 years. Of course, if the singer themselves who choose to develop the contract, it might be an exception, but some of given terms in TVXQ’s FTC case, the proposed standards are so unfair in many ways. It is the best way to realize these points quickly than later”

– Also the cosmetics enterprise which three member and their parents running became known as one axis of the conflict.

“The cosmetics company could be one of the reasons for the discord but not what ultimately convinced the three members to go to court. We have examined the official statement from SM this morning and noticed that SM had painted the make up company as the cause in a negative light on the surface of their statement. If they think that the additional business of the members is the legal case, then it’s a mistake.”

– There’s a conclusion appearing about the crisis that the activities of 3 members who file the lawsuit will be stopped?

(I cant understand this one in details, but basically he said that the members would continue if their disposition is approved, and he hoped it would be soon. The court’s desicion is now in the middle of the most important and difficult variables and he had goal to finish the case within 6 months.”

– The possibility of winning?

“To see it on the bright side… SM Entertainment has in the past been ordered by the Korea FTC several times to reform contracts for violating the standard contract limits. TVXQ are now appealing for the parts that are different from the FTC terms.

– Before taking the legal action, it’s said that the members did not try to make consultation with the agency before.

“We have tried to solve the problem through dialogue. Members had even met directly with the agency. While I was also trying to resolve the problem through multiple channels. However, the agency ignored members opinions, therefore a legal appeal finally made. The members are very sorry to the fans as well.

– What is the conflict regarding to cosmetic issue?

“Should an agency has a fight with artists who are having family’s personal investment? Other celebrities are common to have additional business. Moreover, the three members had already made consultation process with agency representative, Kim Young-Min before they started the cosmetic business, but we feel betrayed then as the company told another story later on.

– TVXQ has already taken the step, but eventually dismantled

“We have already tried many ways, but all the efforts finally bring us here. We’re not too hasty to be in this position. We create legal procedure first before we present every single new plan. The 5 people based their activities together in SM Entertainment, therefore it will not be easy to be in our situation now. “

– Is there a plan for press conference?

It’s necessary but as for now, we don’t have any plan yet. The members are really sorry now to the fans. Actually we want to proceed this case undisturbed.

What the heck is happening here? I’ve only been away for two days and suddenly I read about this news?

Round 1: TVXQ vs SM Entertainment. TVXQ is really breaking up?

Remember last month about the “supposed false rumor” that TVXQ / DBSK / Tohoshinki was breaking up? Well, it seems that information may have actually been true. According to this source, it states that on July 31st, 3 TVXQ Members, specifically Micky Yoochun, Jaejoong, and Xiah Junsu filed an injunction against SM Entertainment in the Seoul Central District Court to remove the “non exclusivity clause” in their contract.

Yunho and Changmin have decided not to file an injunction. Basically in a nutshell, the three of them supposedly had meetings with a Chinese cosmetic company and launched a new cosmetic line called CreBeau. They invested some of their own money and also in turn received some lucrative gifts from the Chinese company as an incentive package for signing up and investing. Some of the rumored gifts includes Micky’s Audi R8 and the townhouse for Xiah’s parents.
SM Entertainment supposedly got wind of this news and because SM Entertainment has the “exclusivity clause” in their contract, SM Entertainment tried to prevent this from happening. Unhappy with this, and already unhappy that they feel they’re being underpaid profit-wise from album sales, you can understand why they’re trying to terminate the “exclusivity clause” in their contracts. There’s also rumors that if a favorable agreement isn’t met, the three will be leaving the group for good.

SM Entertainment via phone to one of the Korean news media outlets stated that they are aware of the situation, the board of directors is having an emergency meeting and are discussing what to do. They’ll have an official statement soon.
Wow, this is crazy. I wonder how this will effect their arrangements with AVEX in Japan? This isn’t new for SM Entertainment as they had their problems with H.O.T. in the past. I just hope that this doesn’t result in an actual disbandment and that everyone can come to peace, for themselves and most importantly their fans. TVXQ is a very talented group and they shouldn’t break up, they have a great thing going.

Update from the lawyers representing Micky, Jaejoong, and Xiah: The three and the lawyers have been discussing this for over 2 months. They tried to settle this with SM Entertainment through negotiations behind closed doors, but they broke down therefore the injunction. The contracts are for 13 years and the profit splits are 80% to SM Entertainment and 20% to TVXQ (divided by 5 for each member). No need to worry girls, things are starting to look much brighter! Earlier reports were looking bad in terms of the relationship between TVXQ and SM Entertainment, SM Entertainment has however released an official statement about the current issue.

SM Entertainment stated, “TVXQ is a band that represents Asia, they must absolutely continue actitivies. The cosmetics company issue, will be resolved.”

TVXQ United Against SM?

There are now new UNOFFICIAL updates floating around in Korea as millions of Cassopeias are going sleepless and searching for more information about their beloved group. Apparently, Yoochun and Junsu have been going around together looking for law firms during their vacation so this was certainly not something that happened overnight.

While all seems calm for now, following the official statement from SM Entertainment, many are awaiting with anxiety with regards to what else will happen in the morning. Many are wondering if SM Entertainment are just papering over the cracks. As of now, all TVXQ notices and schedules on the SM Entertainment homepage have been deleted, including the SM Town Concert schedule.

Perhaps not strange to many but odd considering that they are SM Entertainment’s #1 group now, and TVXQ has had a 13 year (according to some) “slave contract,” with SM Entertainment. And TVXQ members have only received a 0.5% increase in salary over the past 5 years despite their amazing success and huge fanbase. All 5 members are actually preparing to sue SM Entertainment because of this, not just Junsu, Yoochun, and Jaejoong.

Junsu’s dad had been the representative of the 5 members and was at the head of the preparations to sue SM Entertainment. But SM entertainment found out about the pending lawsuit and proceeded to “bully around” Junsu. Yunho and Changmin aren’t sueing SM at the moment, but neither are they resigning with SM at the end of their contract. Contrary to rumors, there has been no conflict within TVXQ members, and the whole issue is been between the members and SM Entertainment.

SM has been taking from 70%-90% of the profits that TVXQ makes, leaving only 10%-30% for the members themselves. Most people think that Jaejoong, Yoochun, and Junsu will win their case because it is against Korean law to make “slave contracts.” And slave contracts they are, receiving less than half is a stretch, but 10%?!?!

Ever since Jaejoong, Yoochun, and Junsu started the cosmetics endorsements, SM Entertainment began to try and put down their efforts, wondering why the members were trying to go into business without first consulting with them. Junsu was being pushed around by a lot of upper officials in SM Entertainment because of his dad’s involvement and his private endorsements.

Yunho and Changmin aren’t betraying TVXQ for not being involved in the law suit. They all have wanted to leave SM Entertainment, but couldn’t because of their contracts. Even if they had wanted to leave, the amount of money fighting lawsuits would be enormous. All 5 members are standing together against SM. It is very distinct that this is not a TVXQ vs. TVXQ fight, but rather a TVXQ against SM fight.

It should be noted that Jaejoong, Yoochun, and Junsu do not want to completely terminate their contract, but they do want major revisions to be done to their contract so that the corrupted control that SM Entertainment has over them can be dissolved.

Ok, I need time to process all this news because it came as a shock to me. Although I do know how “disadvantaged” DBSK members are with their contracts with SM, I didn’t expect something like this to be happening especially since the boys LOOKED like they were ok with it. But I guess this is bound to happen especially since the boys are being overworked and “restricted” in doing so many things over the years.

I honestly don’t know what my stand would be on this issue. I’m glad that JaeJoong, Yoochun, and Junsu (maybe even Changmin and Yunho) have finally decided to take action and fight for the rights that they should have been enjoying even from the start of their careers. They’re working so hard and yet they’re hardwork is not being compensated the way it should be. 10%-30% of profits (which will still be divided into five members) is just an overkill. But apart from that unfair proft-sharing, what is more “opressing” with their contracts is their lack of freedom to do many things. They have endured it for the last five (almost six) years but I guess every bad thing has to come to an end.

But on the other hand, as a DBSK fan, I’m AFRAID. The fear that this issue MIGHT lead to their disbandment is surely killing me. In fact, I wanted to cry when I heard of this news. Knowing SM, he might do the same thing as what he did to H.O.T with DBSK. Them breaking up is the last thing I want. Based from the news, it looks like the boys are united against SM and there are chances of it being resolved but the fear of  them breaking up is something that would linger in me as long as this issue is not resolved.

I’m really hoping for the best for all the members. I hope everything will be settled and that DBSK’s activities will not come to a stop. They’re at the peak of their careers now and I don’t want all their hardwork to go to waste. Whatever the outcome of this issue will be, whether they’ll still be with SM or not, I hope we’ll still see more of DBSK.

I’m sorry for sounding a bit pessimistic. I’m just really confused and taken aback by the news that I can’t help but feel afraid. I love DBSK so much that news like this makes me feel so down and fearful. I just really hope everything will be ok.

Lastly, I just want to clear something out. The news of JaeJoong, Yoochun, and Junsu filing a DISPOSITION (not a lawsuit as earlier posted) against SM seems to be true since SM already released a statement regarding it. BUT DBSK WILL NOT DISBAND. The three MIGHT leave IF SM WON’T REVISE THEIR CONTRACTS but as of now, DBSK is still a group. And I hope it stays that way in the coming days, weeks, months, and years.

Just like with Changmin, I only got a few pictures of Junsu from last night’s concert. I heard that Junsu is sick when they arrived in Korea. I don’t know what it’s called but he has allergy from pollen (if I still correctly remember what I learned from my bio class, pollen comes from flowers, right?) when they were in Japan. I bet he’s still sick when they performed last night but you can’t really notice it if you look at his shots. As we all know, Junsu won’t let his sickness come in the way of his performance. In good health or not, he still gives his all in his performances as if nothing’s wrong. And for that, I really commend him. :D
